Terms of service

These terms govern the use of openIVR Cloud (“the Service”), operated by [COMPANY NAME], [ADDRESS] (“we”). By creating an account you accept them. openIVR itself, the NVR software, is free software distributed under the AGPL-3.0 and is not covered by these terms.
1. The Service
The Service makes an openIVR installation (“a site”) that you operate reachable from the Internet through a relay, provides TURN/STUN servers for WebRTC media, a public address per site, notifications and monitoring as described on the pricing page. The Service does not store video, snapshots or audio. It does not replace your NVR: recording, detection and storage happen on your hardware.
2. Account and sites
You must be at least 18 and provide a valid email address. You are responsible for the confidentiality of your credentials and for everything that happens under your account. A pairing code is valid for ten minutes and links one NVR to one site; you may unpair at any time from openIVR or from the portal.
3. Plans, billing and trial
Plans and prices are listed on the pricing page and in the portal at the time of purchase. Subscriptions are billed in advance, monthly or yearly, through Stripe. The Enterprise Cloud plan is billed per site. Prices exclude VAT unless stated otherwise. [TRIAL: e.g. A 14-day free trial applies to new accounts; no charge is made before it ends.] We may change prices with 30 days' notice by email; the new price applies from your next renewal.
4. Fair use on relayed bytes
The Service is priced flat because most media flows directly between your NVR and your browser. When media must be relayed through TURN, we count the bytes per site and month. Usage above [FAIR-USE CEILING, e.g. 500 GB per site per month] is outside fair use. If a site exceeds it we will contact you first; we may then propose a plan change, reduce relayed bitrate, or, for persistent abuse, suspend relaying for that site. We never inspect the content of relayed bytes.
5. Cancellation and refunds
You may cancel at any time from the portal. The subscription stays active until the end of the paid period and is not renewed. Except where the law requires otherwise, periods already paid are not refunded. Deleting your account revokes all sites immediately.
6. Availability
We operate the Service with care but, for the Cloud Access and Cloud Access Pro plans, without any availability guarantee. Maintenance windows and incidents are announced on the status page. The Enterprise Cloud plan includes a 99.9 % monthly availability commitment for the relay; the remedies for missing it are set out in [SLA ANNEX / LINK]. Your NVR keeps working locally whether or not the relay is reachable.
7. Acceptable use
You agree not to use the Service to relay traffic other than that of your own openIVR sites, to attempt to reach sites you do not own, to circumvent authentication, rate limits or fair use, or to disrupt the Service. You are solely responsible for the lawfulness of your cameras and recordings, including signage, field of view and any consent required where they are installed. We may suspend an account that breaches this section, after notice where reasonably possible.
8. Data protection
Our privacy policy describes what we process. For video that transits through the relay, you are the controller and we are a processor acting only in transit; a data processing agreement is available on request for Pro and Enterprise customers.
9. Liability
To the extent permitted by law, our total liability under these terms is limited to the amounts you paid for the Service in the twelve months preceding the claim. We are not liable for indirect damage, loss of recordings, loss of profit, or for events you did not see because remote access was unavailable. Nothing in these terms limits liability for intent or gross negligence, or for damage to life, body or health.
10. Changes to the Service and to these terms
We may improve or change the Service. Material changes to these terms are announced by email at least 30 days before they take effect; continuing to use the Service after that date means you accept them. If you disagree you may cancel before the date.
11. Governing law
These terms are governed by [GOVERNING LAW, e.g. Swiss law]. Courts of [JURISDICTION] have exclusive jurisdiction, subject to mandatory consumer-protection rules of your country of residence.
